Terms and conditions
Reservation
A reservation shall only be deemed confirmed once the guest has received a written booking confirmation from The Willow Tree and/or The White Cottage (the “Host”). The Host reserves the right to refuse or cancel any reservation at its sole discretion prior to confirmation.
Cancellation & Payment Policy
Cancellations made more than twenty-eight (28) days prior to the scheduled check-in date may be cancelled free of charge.
In the event of cancellation, modification, reduction of stay, or no-show within twenty-eight (28) days prior to check-in, the full reservation amount shall become immediately due and payable, and no refund shall be issued.
Full payment of the reservation amount must be received no later than twenty-eight (28) days prior to arrival, unless otherwise agreed in writing.
If payment is not received in full by the due date, the Host reserves the right to cancel the reservation immediately, without prior notice and without prejudice to any other rights or remedies available to the Host.
Cancellation of the reservation by the Host due to late or non-payment shall not release the guest from their payment obligations. The full reservation amount shall remain payable in full.
The Host further reserves the right to recover any damages, losses, administrative costs, legal expenses, loss of income, or other costs incurred as a result of the guest’s failure to comply with the payment obligations under this agreement.
If the accommodation is successfully re-booked for all or part of the cancelled reservation period, the Host may, at its sole and absolute discretion, refund all or part of the re-booked nights, less any administrative costs and losses incurred.
The Host shall not be liable for any loss, damages, alternative accommodation costs, travel expenses, or other consequential damages arising from cancellation of the reservation due to the guest’s failure to make timely payment.
Guests are strongly advised to obtain comprehensive travel and cancellation insurance.
These terms and conditions shall be governed exclusively by Dutch law. Any dispute arising out of or relating to the reservation, the accommodation, or these terms and conditions shall be submitted exclusively to the competent court in the Netherlands.
Arrival and Departure
Check-in is available from 16:00 on the day of arrival. Check-out must take place no later than 10:00 on the day of departure.
Late check-out without prior written approval may result in additional charges.
Guests are required to inform the Host in advance of their estimated arrival time.
Occupancy
Only the persons expressly listed in the booking confirmation are permitted to occupy the accommodation.
Subletting, sharing, overnight visitors, additional guests, parties, gatherings, or unregistered visitors are strictly prohibited without the Host’s prior written consent.
The maximum occupancy of the accommodation may not exceed the number of guests confirmed at the time of booking under any circumstances.
The primary guest making the reservation must be at least twenty-five (25) years of age and must remain present at the accommodation throughout the stay.
The Host reserves the right to refuse access to, or immediately terminate the stay of, any unauthorized persons without refund.
Liability
The Willow Tree and/or The White Cottage (the “Host”) shall not be liable for any injury, accident, illness, death, theft, loss, or damage to persons, belongings, vehicles, or other property suffered by the guest or any accompanying persons during or as a result of their stay, except in cases of intent or gross negligence on the part of the Host where liability cannot legally be excluded under Dutch law.
Use of the accommodation, grounds, facilities, appliances, stairs, terraces, parking areas, and all indoor and outdoor amenities is entirely at the guest’s own risk.
The Host accepts no liability for temporary interruptions or defects relating to utilities, internet access, television services, heating, water supply, electricity, air conditioning, or facilities beyond the Host’s reasonable control.
The Host shall not be liable for nuisance, inconvenience, noise, construction works, roadworks, neighboring activities, environmental factors, weather conditions, insects, animals, or other external circumstances beyond the Host’s control.
The guest shall be fully liable for all damage caused to the accommodation, furnishings, inventory, keys, fixtures, or surrounding property by the guest, accompanying persons, visitors, or pets during the stay, regardless of whether such damage was caused intentionally, negligently, or through improper use.
The guest agrees to indemnify and hold harmless the Host, its owners, employees, representatives, and agents against all claims, liabilities, damages, losses, penalties, costs, and expenses arising out of or related to the guest’s use of the accommodation.
The Host strongly recommends that guests maintain adequate travel, medical, accident, and personal liability insurance coverage during their stay.
Force Majeure
The Host shall not be liable for any failure, interruption, cancellation, delay, defect, or inability to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, epidemics, governmental measures, extreme weather conditions, fire, flooding, power outages, internet outages, strikes, war, civil unrest, or other events of force majeure.
In such circumstances, the Host reserves the right to cancel or modify the reservation without liability for compensation or damages.
Conduct and Disturbance
Guests shall behave in a respectful and responsible manner at all times and shall refrain from causing nuisance, disturbance, excessive noise, illegal activity, unsafe situations, or inconvenience to neighbors, the Host, or surrounding properties.
The Host reserves the right to immediately terminate the stay, deny access to the accommodation, remove guests from the property, and/or involve law enforcement in the event of violation of the house rules, illegal conduct, aggressive behavior, public disturbance, or breach of these terms and conditions.
In such cases, no refund or compensation shall be due.
Security Deposit
A security deposit may be required prior to check-in.
The Host reserves the right to retain part or all of the security deposit in the event of damage, excessive cleaning, unauthorized occupancy, smoking violations, missing items, breach of house rules, or any unpaid charges.
If the damages or losses exceed the amount of the security deposit, the guest shall remain fully liable for the outstanding balance.
The security deposit, or remaining balance thereof, shall be refunded within seven (7) days after departure and inspection of the accommodation, provided no violations, damages, or additional costs have occurred.
Compliance and Termination
Failure to comply with these terms and conditions or the house rules shall constitute a material breach of the rental agreement.
The Host reserves the right to terminate the rental agreement immediately, without notice of default, judicial intervention, or refund, if:
- payment obligations are not fulfilled in full and on time;
- the guest provides false or misleading booking information;
- unauthorized persons are present at the accommodation;
- the guest causes nuisance, damage, unsafe situations, or disturbance;
- the guest violates any applicable law or house rule;
- the accommodation is used in a manner inconsistent with its intended residential and recreational purpose.
Termination of the stay shall not affect the Host’s right to recover damages, costs, unpaid amounts, or losses suffered as a result of the breach.
Upon termination or departure, all rights to compensation, reimbursement, or refund shall lapse in full.
Children
For safety and insurance reasons, children under the age of twelve (12) are not permitted at the accommodation unless expressly agreed otherwise in writing by the Host.
Parents and accompanying adults remain fully responsible for the supervision, safety, conduct, and well-being of minors at all times.
Use of the accommodation, grounds, stairs, terraces, parking areas, and all indoor and outdoor facilities is entirely at the guest’s own risk.
The Host accepts no liability for accidents, injuries, or damages involving minors except where liability cannot legally be excluded under Dutch law.
Use of Address for Mail or Packages
The accommodation address may not be used by guests as a postal address, registration address, business address, or delivery address for mail, parcels, online orders, subscriptions, or commercial activities.
Any mail, parcels, or deliveries sent to the accommodation may be refused, returned, removed, or disposed of by the Host without notice or liability.
The accommodation is intended exclusively for temporary recreational lodging and may not be used for administrative, residential registration, or commercial purposes.
Guests shall be fully liable for all costs, damages, penalties, claims, or consequences arising from unauthorized use of the address.
Toilet and Plumbing Use
Only toilet paper may be disposed of in the toilets.
It is strictly prohibited to dispose of wet wipes, baby wipes, sanitary products, tampons, cotton pads, cotton swabs, diapers, fats, oils, food waste, chemicals, medication, or any other materials in the toilets, sinks, drains, or plumbing system.
Guests shall be fully liable for all damages, blockages, repairs, specialist call-out costs, cleaning costs, and consequential damages resulting from improper use of the plumbing or sewage system.
Damage, Cleaning, and Condition of the Accommodation
Guests shall treat the accommodation, furnishings, inventory, appliances, fixtures, and surrounding property with due care and shall maintain the accommodation in a clean, hygienic, and orderly condition throughout the stay.
The guest shall immediately report any damage, malfunction, defect, or incident to the Host.
Any damage, loss, staining, breakage, missing inventory, excessive dirt, odors, smoke contamination, or misuse occurring during the stay shall be charged to the guest.
If the accommodation is not left in an acceptable condition upon departure, the Host reserves the right to charge additional cleaning, repair, replacement, deodorizing, waste removal, or restoration costs.
Normal wear and tear shall be excluded.
Tourist Tax
Any applicable tourist tax, municipal levy, visitor tax, or governmental charge shall be payable by the guest in accordance with local regulations.
Unless otherwise stated, tourist tax must be paid in cash upon arrival.
Other Terms
The Host reserves the right to amend, update, or supplement these terms and conditions and house rules at any time.
Should any provision of these terms be deemed invalid, illegal, or unenforceable under applicable law, the remaining provisions shall remain fully valid and enforceable.
Failure by the Host to enforce any provision of these terms shall not constitute a waiver of any rights.
These terms and conditions constitute the entire agreement between the Host and the guest and supersede all prior communications, representations, or agreements, whether oral or written.
Additional House Rules
Guests shall comply with all instructions provided by the Host regarding safety, maintenance, sustainability, and proper use of the accommodation.
Bathroom windows must be opened after showering to ensure adequate ventilation and prevent moisture damage.
Music, amplified sound, or loud noise outdoors, including on terraces or in gardens, is prohibited at all times unless expressly approved by the Host.
Guests shall use energy, water, heating, and air conditioning responsibly. Doors and windows must remain closed while air conditioning or heating is in operation.
Air conditioning must be switched off whenever the accommodation is unattended.
Charging electric vehicles from the accommodation’s electrical system is prohibited unless expressly authorized by the Host.
Use of the washing machine and dryer may be subject to additional charges.
Guests must provide their own detergent unless otherwise stated.
Waste separation is mandatory in accordance with municipal regulations. Guests must separate residual waste, glass, paper, plastic, and cans in the designated containers.
Failure to separate waste properly may result in additional waste processing charges.
Smoking, vaping, candles, incense, fireworks, barbecues, and any open flames are strictly prohibited in and around the accommodation.
Any violation of smoking or fire safety rules may result in immediate termination of the stay, additional cleaning or deodorizing charges, liability for damages, and forfeiture of the security deposit.
Additional House Rules for the Apartment
The skylight curtain in the bedroom may not be used as a sunshade during periods of direct sunlight, as excessive heat may cause damage or cracking to the window.
When cooking, guests must operate the extractor hood at the highest setting and ensure adequate ventilation to prevent odors, smoke accumulation, and activation of the fire alarm system.
Guests are strictly prohibited from feeding, handling, or allowing the owner’s pets inside the accommodation.
Guests shall be fully liable for any damage resulting from misuse of appliances, ventilation systems, windows, alarms, or fixtures.
Additional House Rules for The Cottage
The natural stone floors, countertops, and bathroom surfaces are highly sensitive to acidic substances, including but not limited to vinegar, lemon juice, fruit juices, cleaning agents, bleach, degreasers, carbonated beverages, and similar products.
Guests must immediately clean and rinse any spills on natural stone surfaces with water to prevent permanent damage, staining, or corrosion.
Cutting directly on stone countertops, dragging furniture, or improper use causing scratches, chips, or surface damage is prohibited.
The guest shall be fully liable for restoration, repair, or replacement costs resulting from damage to natural stone surfaces.
Use of the gas fireplace is strictly prohibited.
Unauthorized use of the fireplace shall constitute a serious breach of the house rules and may result in immediate termination of the stay without refund.
Departure Instructions
Check-out must take place no later than 10:00 unless otherwise agreed in writing.
Prior to departure, guests must:
- leave the accommodation in a clean, tidy, and orderly condition;
- vacuum floors where necessary;
- wash, dry, and store all dishes and kitchen utensils;
- empty the dishwasher;
- dispose of waste in the designated containers;
- open curtains and ventilate the bathroom;
- switch off lights, air conditioning, heating, and appliances;
- close and lock all windows and doors;
- return all keys to the Host.
Guests must immediately report any damage, defects, accidents, or missing items prior to departure.
